Associate Rewards Program Terms

BY LOGGING IN AND USING THIS SITE, YOU AGREE TO THESE TERMS. 

The Associate Rewards program (the “Program”) is designed to reward certain Hyatt colleagues for enrolling guests in the World of Hyatt program. 

These are Program Terms & Conditions (“Terms”) that govern the Program, which is brought to you by Hyatt. The terms “Hyatt,” “we,” “our,” “us” and other similar terms are used for convenience in these Terms to refer collectively and/or individually to one or more of the affiliates and/or subsidiaries of Hyatt Corporation. The terms “Member,” “you,” “your” and other similar terms are used for convenience in these Terms to refer to an individual Member in the Program. The “Program Term” refers to the period of time between the launch of the Program and its termination, if any. 

You agree to these Terms by participating in the Program. The Program does not create any employment relationship between you and Hyatt, any of Hyatt’s affiliates, or any hotel operating under a Hyatt brand, or otherwise affect any pre-existing or independent employment relationship you may have. 

Your participation in the Program is governed by these Terms. It is your responsibility to read and understand these Terms, including any updates that may be posted. Information about the Program and these Terms is available on the program website, worldofhyatt.programhq.com (“Program Site”). 

ELIGIBILITY FOR MEMBERSHIP & ENROLLMENT 

  1. Membership in the Program is by invitation only. Hyatt may limit the number of Members in the Program and may temporarily or permanently discontinue registering new Members at any time and for any reason without notice. Eligibility to participate in the program shall be determined in Hyatt’s sole and exclusive discretion. Membership in a similar program or during a different membership period does not guarantee membership in this Program. 
  2. To be eligible to become a member in the Program (a “Member”), a colleague must be employed by Hyatt or any of its affiliates, or by a third party licensee or franchisee of Hyatt, at a Participating Location. Program membership is generally intended for colleagues whose job duties reasonably require direct interaction with guests (in Hyatt’s sole discretion). “Participating Location” includes: (i) any Hyatt corporate office and/or Hyatt Global Care Centers (but specifically excluding the Marion Reservation Center in Marion, Illinois and the Global Care Center in Omaha, Nebraska); (ii) any hotel or resort owned, managed, operated, franchised or licensed by Hyatt and/or one of its affiliates operating under a Participating Brand; and (iii) spas, restaurants, bars and other food and beverage outlets owned or operated by Hyatt or any of its affiliates located on the premises of such hotels or resorts. “Participating Brands” include the brands included as “Point Properties” in the World of Hyatt Terms & Conditions
  3. Membership is for individuals only. The Program is open only to individuals who are at least 18 years of age and the age of majority where they live. Participation in the Program is unauthorized in any jurisdiction where all or any portion of the Program may violate any legal requirements, and you agree not to participate in the Program in any such jurisdiction. You are responsible for compliance with applicable laws. If participating in the Program would result in you violating any law, rule, regulation, order, or employer policy applicable to you or any agreement to which you are a party, then you are ineligible to participate.
  4. A single membership cannot be shared, used, pooled, or combined by more than one person. Members may not share, pool, or transfer Points, and Points may only be redeemed by the Member who earned them. 
  5. If you are eligible to participate in the Program, an account in the Program will be created for you and associated with your Global ID when you complete your first Qualifying Enrollment. We will maintain this account in accordance with these Terms. Once this account has been created, the Program will send an automated email (the “Welcome Email”) to the email address on file for you with Hyatt’s Global Active Directory. If you do not have an email address on file with Hyatt’s Global Active Directory, you will not receive a Welcome Email but an account will still be created for you. If you would like to update your information, or if you believe you may have completed a Qualifying Enrollment but have not received a Welcome Email, please contact us at the contact information available on the Program Site. 
  6. The Welcome Email will contain information about the Program, a link to the Program Site and these Terms, and login information for the Program Site. Please use the login information provided to set your personal password and to ensure that any contact information about you (including but not limited to your primary email address) is correct. The Program will use the contact information you’ve provided to contact you throughout the Program Term. Once you have logged in to the Program Site and accepted these Terms, you will be officially become a Member in the Program. 
  7. Your Hyatt Global ID number will at all times serve as your member number in the Program (“Member Number”).  

OBLIGATION TO DISCLOSE PROGRAM PARTICIPATION 

  1. Each Member is solely responsible for ensuring membership in the Program does not violate his/her employer’s policies and, if required, terminating membership in the Program. 
  2. Each Member is solely responsible for ensuring his/her employer’s policies allow participation in the Program, including the earning and use of any points or benefits under the Program. If a Member’s employer’s policies prohibit any activity under this Program, it is the individual Member’s sole responsibility to terminate membership in the Program. 
  3. If necessary, each Member is solely responsible for notifying his/her employer of the Program and any points or other benefits such Member may earn related to his/her employer’s activity. 

EARNING POINTS 

  1. This Program awards points (“Points”) to a Member for Qualifying Enrollments of Hyatt guests in the World of Hyatt program. A “Qualifying Enrollment” occurs when the Member successfully enrolls an individual in the World of Hyatt program and records his or her Member Number in the appropriate field of the enrollment path using the applicable point-of-sale system. 
  2. A Member will earn one (1) Point per Qualifying Enrollment he or she completes during the Program Term. 
  3. Points will be awarded during the Program Term for Qualifying Enrollments only. Points will not be retroactively credited for enrollments for which the Member’s Member Number is not recorded. A Member’s Points balance at the time he or she officially becomes a Member, however, will reflect Points previously awarded to the Member’s account for Qualifying Enrollments completed (provided such Points have not lapsed or been redeemed in accordance with these Terms). Qualifying Enrollments completed after the Program Term will not be eligible for any Points. 
  4. Points will be issued to only one (1) Member per single Qualifying Enrollment. If multiple Members have assisted in completing the Qualifying Enrollment, Hyatt will decide in its sole discretion to which Member Hyatt will issue the Points. 
  5. Hyatt may also decide in its sole discretion to offer additional Points in connection with promotions hosted by the Program from time to time (“Promotional Points”). Promotional Points may be subject to additional terms and conditions, which Hyatt will communicate to Members as appropriate in connection with any applicable promotions. 
  6. Hyatt may offer additional rewards or benefits in connection with the Program. Such additional benefits and/or rewards may be subject to additional terms, which will be disclosed when they are offered. 

ABOUT POINTS 

  1. Points can only be redeemed for products and services offered on the Program Site or as otherwise expressly permitted in these Terms. Points may not be used for any other purpose. 
  2. The sale, exchange, transfer, or barter of Points other than by Hyatt or as expressly authorized by Hyatt is prohibited. Points that have been transferred, sold, assigned, or used or attempted to be used in violation of these Terms may be confiscated or canceled. 
  3. Points have no monetary value, cannot be redeemed for cash, and are not property of the Member. 
  4. Points will be deposited in Member accounts weekly and take into account Qualifying Enrollments that occurred in the immediately preceding week. To view the Points in your account at any time, visit the Program Site. 

REDEEMING POINTS 

  1. Members may redeem their Points for the goods and services offered on the Program Site (collectively, the “Rewards”). The Rewards selection varies by geographic location, and may be updated and revised from time to time in Hyatt’s sole discretion. Rewards are subject to availability. 
  2. Members may only redeem Points for Rewards during designated redemption windows (“Redemption Windows”), as determined by Hyatt in its sole discretion and communicated to Members from time to time through the Program Site. 
  3. Hyatt may impose reasonable conditions on a Member’s ability to review available Rewards on the Program Site and/or redeem Points for Rewards, provided such conditions do not unduly burden a Member’s ability to access Rewards available under the Program. Hyatt will communicate any such conditions to Members when appropriate. 
  4. When redeeming Points for Rewards, please note whether the Point value designated for the Reward includes applicable taxes, shipping, costs and/or fees. 
  5. Rewards may constitute taxable income under applicable tax laws. Contact your employer’s payroll department and/or your tax preparation professional for additional information regarding the taxability and/or tax treatment of any Rewards. Any disclosure obligation and/or tax liability associated with Points, Rewards, and/or any other Program benefit are each Member’s sole responsibility. 
  6. When redeeming Points for Rewards, please note any applicable return policy(ies), which may limit or condition your ability to return the applicable Rewards. 
  7. If Hyatt in its sole discretion determines and any Points redeemed for Rewards were or may be removed pursuant to these Terms, Hyatt may immediately revoke any such redemption and remove the Points from Member. In the instance Member receives any Rewards that were redeemed with some or all Points that were or may be removed pursuant to these Terms, Member shall be required to promptly return any such Reward to Hyatt and shall not be reimbursed any Points redeemed for such Reward. 
  8. If Hyatt in its sole discretion determines that a Member has utilized another Member’s Points or another Member account to redeem Points for Rewards, Hyatt may immediately revoke any such redemption or require immediate return of such Rewards. 

MAINTAINING ACCOUNT INFORMATION

  1. You are responsible for maintaining the confidentiality of your account information, including your Member Number. 
  2. You may go to the Program Site to view the Points currently available in your account, as well as to browse available Rewards and to redeem Points for Rewards (when permitted under these Terms). 
  3. Hyatt is entitled to act on instructions received under a Member’s Member Number. Members are responsible for keeping their Member Number and other membership information confidential. Hyatt is not responsible for any actions taken by anyone else using a Member’s Member Number. 
  4. You are responsible for providing and maintaining complete and accurate account information during the Program Term. Hyatt is not responsible for any adverse membership effects arising from failure by a Member to maintain accurate account information, including contact information, on the Program Site. Such adverse effects may include, but shall not be limited to, missed Redemption Windows, failure to accrue Points for Qualifying Enrollments, and/or termination of membership and forfeiture of Points due to account inactivity. 
  5. Any errors or omissions on transactions posted to a Member’s account must be reported in writing to Hyatt within 90 days of the error in order for Hyatt to reconcile the membership and make any required adjustments to the Member’s account. 
  6. If Hyatt credits any Points or other benefits to a Member or a Member’s account in error where such Points or other benefits were not legitimately earned in accordance with these Terms, or if Hyatt fails to credit any Points or other benefits to a Member or Member’s account in error where such Points or other benefits were legitimately earned in accordance with these Terms, Hyatt may correct and remedy the situation in its sole discretion. 

COLLEAGUE TERMINATIONS AND TRANSFERS

  1. If a Member changes employment (position or employer) but, after the change, remains eligible to participate in the Program as a Member pursuant to these Terms, the Member’s employment change will not affect the Member’s status or participation in the Program. 
  2. If, because of a Member employment change (position or employer), such Member is no longer eligible to participate in the Program as a Member pursuant to these Terms, (i) the Member will no longer be eligible to earn Points, and (ii) the Member’s membership will remain active and eligible for Reward redemptions as set forth herein for the remainder of the calendar year of Member’s employment change or until the Member’s membership is terminated by the Member or by Hyatt in accordance with these Terms, whichever occurs earlier. 
  3. If a Member is terminated from their employment, any use of remaining Points of Member is contingent upon approval from the last hotel of employment and Hyatt, such approval or disapproval shall be in the sole discretion of the hotel and Hyatt. 
  4. In the event your employment status (position or employer) changes in any way, you are responsible for making any necessary updates to your account information. 

LOSS OF POINTS; TERMINATION OF MEMBERSHIP

  1. Hyatt may immediately, without notice and at any time, remove Points from you if, in its sole discretion, you: (i) violate these Terms or any other applicable additional terms or appear to be utilizing the Program in a manner inconsistent with these Terms or the intent of the Program; (ii) are suspected or found to be acting in an abusive or fraudulent manner or engaging in any conduct that artificially, improperly, or deceptively impacts the accumulation, use, or loss awards or benefits (including without limitation use of any “bot,” macro, or other automated means of participating in the Program); (iii) attempt to transfer your account or benefit or awards to another Member or a third party, except as expressly permitted by these Terms or by Hyatt; (iv) make any misrepresentation in connection with the Program; (v) impair the normal functioning of the Program Site or the Program; (vi) act in a manner detrimental to Hyatt, a Hyatt employee or colleague, other Member, or any third party (including without limitation behaving towards any Hyatt employee or colleague or Hyatt guest in any manner that is abusive, harassing, threatening, derogatory, disrespectful, lewd, obscene, offensive, or otherwise inappropriate, all as determined by Hyatt in its sole discretion); or (vii) act in any manner inconsistent with local, state, provincial, national, or federal laws, regulations, orders, or other rules. All decisions by Hyatt regarding removal of Points shall be final. Under no circumstances will removed Points be reinstated. This provision applies to both Points and Promotional Points. 
  2. If Hyatt in its sole discretion determines that any violation of these Terms is at the direction of, influenced by, or is otherwise related to the management or leadership of any Participating Location, it may direct such Participating Location to reimburse Hyatt for any Points that were awarded in violation of these Terms. 
  3. A Member may voluntary terminate membership in the Program at any time for any reason by contacting Hyatt at the contact information available on the Program Site. Once you submit a termination request, termination is irreversible and your account will be closed and all Points, awards, and benefits of any type forfeited. 
  4. Membership may be discontinued by Hyatt at any time for any reason, including without limitation due to a Member’s limited activity in the Program. Should a Member fail to complete one (1) Qualifying Enrollment in any consecutive twelve (12) month period, Hyatt may, in its sole discretion, terminate such Member’s membership. This amount may be updated by Hyatt at any time, and completing one (1) Qualifying Enrollment in a twelve (12) month period does not guarantee that your membership will continue. If your membership is terminated due to inactivity, any Points associated with your membership will be forfeited.
  5. Hyatt may immediately, without notice, limit or terminate your membership if, in its sole discretion, you: (i) have no or minimal qualifying activities, as determined by Hyatt in its sole discretion; (ii) violate these Terms or any other applicable additional terms or appear to be utilizing the Program in a manner inconsistent with these Terms or the intent of the Program; (iii) are suspected or found to be acting in an abusive or fraudulent manner or engaging in any conduct that artificially, improperly, or deceptively impacts the accumulation, use, or loss awards or benefits (including without limitation use of any “bot,” macro, or other automated means of participating in the Program); (iv) attempt to transfer your account or benefit or awards to another Member or a third party, except as expressly permitted by these Terms or by Hyatt; (v) make any misrepresentation in connection with the Program; (vi) impair the normal functioning of the Program Site or the Program; (vii) act in a manner detrimental to Hyatt, a Hyatt employee or colleague, other Member, or any third party (including without limitation behaving towards any Hyatt employee or colleague or Hyatt guest in any manner that is abusive, harassing, threatening, derogatory, disrespectful, lewd, obscene, offensive, or otherwise inappropriate, all as determined by Hyatt in its sole discretion); or (viii) act in any manner inconsistent with local, state, provincial, national, or federal laws, regulations, orders, or other rules. 
  6. If your membership is terminated for any reason, you will lose all Points, awards, and benefits associated with your account, and you will no longer be able to earn or redeem Points, awards and benefits in the Program. Your future participation in the Program may also be prohibited in Hyatt’s sole discretion. 

NO WARRANTIES; LIMITATION OF LIABILITY

  1. THIS PROGRAM IS MADE AVAILABLE TO YOU ON AN AS-IS, AS-AVAILABLE BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HYATT AND ITS EMPLOYEES MAKE NO REPRESENTATION ABOUT THE SUITABILITY OF THE PROGRAM FOR YOU. THE HYATT PARTIES SPECIFICALLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. YOUR PARTICIPATION IN THE PROGRAM IS AT YOUR OWN RISK. 
  2. WITHOUT LIMITING THE FOREGOING, HYATT AND ITS EMPLOYEES DO NOT REPRESENT OR WARRANT THAT THE INFORMATION RELATED TO THE PROGRAM IS ACCURATE, COMPLETE, RELIABLE, USEFUL, TIMELY, OR CURRENT OR THAT THE PROGRAM WILL OPERATE WITHOUT INTERRUPTION OR ERROR. DESPITE COMMERCIALLY REASONABLE EFFORTS, THE PROGRAM SITE AND OTHER PROGRAM MATERIALS MAY CONTAIN TYPOGRAPHICAL OR OTHER ERRORS OR INACCURACIES, INCLUDING, WITHOUT LIMITATION, REGARDING THE AMOUNT OR VALUE OF POINTS, A PARTICULAR AWARD, THE POINTS AND BENEFITS OF THE PROGRAM OR WHAT IS REQUIRED TO EARN THOSE POINTS OR BENEFITS, OR THE ABILITY TO REDEEM OR RECEIVE A BENEFIT. HYATT AND ITS EMPLOYEES WILL BE RESPONSIBLE FOR ANY SUCH ERROR, TYPO, OR MISPRINT IN THESE TERMS OR ANY PROGRAM MATERIALS. HYATT RESERVES THE RIGHT TO VOID OR REFUSE TO PROCESS BENEFIT OR TRANSACTION ARISING OUT OF SUCH AN ERROR, TYPO, OR MISPRINT. 
  3. HYATT AND THE OWNERS, OPERATORS, FRANCHISEES, DIRECTORS, MANAGERS, AND EMPLOYEES OF ANY HYATT PROPERTY (COLLECTIVELY, THE “HYATT PARTIES”) WILL NOT BE LIABLE FOR ANY ACTS, ERRORS OR OMISSIONS OF ANY OTHER MEMBER, THIRD PARTY OR PROGRAM PARTNER OR ANY PARTNER’S LOYALTY OR REWARDS PROGRAM. 
  4. IN NO EVENT WILL A HYATT PARTY BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE PROGRAM. YOU AGREE THAT HYATT’S TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH OR ARISING OUT OF THE PROGRAM AND THESE TERMS, WILL NOT EXCEED THE LESSER OF TEN UNITED STATES DOLLARS ($10.00) OR THE AMOUNT PAID BY YOU, IF ANY, DIRECTLY SPECIFIC TO PARTICIPATION IN THE PROGRAM, PLUS ANY PREVAILING PARTY COSTS OR FEES RECOVERABLE PURSUANT TO APPLICABLE LAW. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. 
  5. THE LIMITATIONS SET FORTH IN THESE TERMS WILL NOT LIMIT OR EXCLUDE THE HYATT PARTIES’ LIABILITY FOR PERSONAL INJURY OR TANGIBLE PROPERTY DAMAGE CAUSED BY THE HYATT PARTIES, OR FOR THE HYATT PARTIES’ GROSS NEGLIGENCE, FRAUD, OR INTENTIONAL, WILLFUL, MALICIOUS, OR RECKLESS MISCONDUCT. 
  6. This entire section will survive the termination of this Program and your membership in it. 

TERMINATION AND/OR MODIFICATION OF PROGRAM AND TERMS

  1. HYATT RESERVES THE RIGHT TO TERMINATE THE PROGRAM AT ANY TIME. ANY POINTS, AWARDS, OR OTHER BENEFITS THAT YOU EARNED OR THAT ARE IN YOUR ACCOUNT OR OTHERWISE HELD BY YOU ON THE EFFECTIVE DATE OF TERMINATION WILL BE FORFEITED UNLESS HYATT ANNOUNCES OTHERWISE. Hyatt may determine in its sole discretion how to handle any Points or other benefits relating to activities occurring after the effective date of termination of the Program. Such discretion may include declining to provide any Points or benefits after the effective date of the termination. 
  2. Hyatt reserves the right to modify these Terms from time to time by providing reasonable notice to Members. Hyatt will notify Members of changes to the Terms by posting them to the Program Site and may also notify you by email or mail to the address then associated with your account. The updated Terms will be effective as of the time of posting, or upon such later date or by such other method as specified by Hyatt. Unless otherwise stated, the updated Terms will apply to your participation in the Program beginning as of their effective date. 
  3. In addition, Hyatt reserves the right to, from time to time, among other things: change, withdraw, limit, modify, or cancel any award, benefit, or program inclusion; increase or alter the requirements to earn or use an award or benefit; modify the points or benefits available under the Program; and any other changes that Hyatt determines in its sole discretion. Hyatt may limit the number of Members in the Program and may temporarily or permanently discontinue registering new Members at any time and for any reason without notice. 

GENERAL TERMS

  1. Except as expressly set forth herein, this Program has no connection to any other program operated or offered by Hyatt. 
  2. The Program, Membership in it, the awarding and provision of Points or benefits are void where prohibited by law. All aspects of the Program are subject to applicable laws, rules, and regulations. 
  3. Members are responsible for notifying Hyatt of any email address, phone number or name changes. 
  4. The Program, these Terms, and any disputes between you and Hyatt associated with the Program or these Terms will be governed by the laws of the State of Illinois, United States of America, without reference to its conflict of laws principles. Exclusive jurisdiction over any cause of action arising out of or related to the Program or these Terms will be in courts located in or having jurisdiction over Cook County, Illinois, United States of America. You further agree to submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. 
  5. If any provision of these Terms is invalid or unenforceable under applicable law, such provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms will govern such participation. 
  6. These Terms constitute the entire and exclusive agreement between you and Hyatt with respect to the Program. These Terms supersede all prior or contemporaneous terms, communications, agreements, advertising, and proposals, whether electronic, oral or written, with respect to this Program. You acknowledge that you have not been induced to enter into these Terms by any representations or promises not specifically stated in these Terms. 
  7. You agree that nothing contained in these Terms is in derogation of Hyatt’s right to comply with law enforcement or governmental requests or requirements relating to your participation in the Program or information provided to or gathered by Hyatt with respect to such participation. 
  8. A printed version of the Terms and of any notice given by Hyatt in electronic form will be admissible in judicial, arbitrative, or administrative proceedings relating to these Terms or your participation in the Program to the same extent and subject to the same conditions as other business documents and records originally generated and maintained by Hyatt in printed form. 
  9. In the event there is a discrepancy or inconsistency between the English language version and another version of these Terms in a different language, the English version will prevail and control. 
  10. The Hyatt Parties are not responsible or liable to you, or any person claiming through you, for failure to supply or fulfill an award or benefit in the Program in the event the Program is affected by any acts of god, any action, regulation, order or request by any governmental or quasi-governmental entity, technical failure, actual or threatened terrorist act, weather, natural phenomenon, war (declared or undeclared), fire, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, civil disturbance, insurrection, riot, or any law, rule, regulation or order or other action adopted or taken by any national, federal, state, provincial, or local government authority, or any other cause, even if or not specifically mentioned above. 
  11. If and to the extent that there is any conflict among or between the Program Site, other Program marketing materials and these Terms, these Terms will govern. Hyatt’s failure to or decision not to enforce any provision in the Terms will not constitute a waiver of that or any other provision. The invalidity or unenforceability of any provision of the Terms will not affect the validity or enforceability of any other provision. All interpretations of these Terms shall be at Hyatt’s sole discretion. All such decisions are final and binding on you and you agree to abide by them.
